1. Introduction and Acceptance of Terms

Welcome to Nano Banana Pro ("Nano Banana Pro", "we", "us" or "our"), an AI image and video generation service operated by an independent developer (sole trader).

These Terms of Service ("Terms") govern your access to and use of our AI-powered services — text-to-image, image-to-image, text-to-video and image-to-video generation, together with related editing tools — available at https://nano-banana-pro.com (the "Service").

By creating an account, subscribing to any plan, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood and agree to be bound by these Terms; (c) agree to our Privacy Policy and Acceptable Use Policy; and (d) are authorised to enter into this agreement on behalf of yourself or any organisation you represent.

⚠️ Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Service Description

2.1 What We Provide

Nano Banana Pro is an AI-powered platform that lets you generate and edit images and video from text prompts and reference images. The Service is a digital software-as-a-service product delivered over the internet.

2.2 Nature of the Service

The Service is a digital, intangible product. Once payment is confirmed, credits and plan access are granted immediately. Because delivery is immediate, specific limitations apply to refunds as described in Section 7.

2.3 Independent Product and No Affiliation

Nano Banana Pro is an independent third-party platform. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to Google LLC, Black Forest Labs, ByteDance, xAI, Alibaba, or any other AI model provider.

Our generation features are powered by AI models that we access through third-party API providers. References to those models on this website are made solely to describe the technical capabilities available through our platform.

All product names, model names, logos and trademarks — including but not limited to "Nano Banana", "Gemini", "Google", "FLUX", "Seedream", "Veo", "Grok" and "Wan" — are the property of their respective owners. Their use on this website is for descriptive and identification purposes only and does not imply any partnership, endorsement or official relationship.

2.4 Underlying AI Models

We are transparent about the models that power the Service. Generation on Nano Banana Pro is performed by the following third-party models:

Image generation and editing

Google Gemini image models — "Nano Banana", "Nano Banana 2" and "Nano Banana Pro" (gemini-3-pro-image-preview)
Black Forest Labs FLUX.2 — Pro and Flex (text-to-image and image-to-image)
ByteDance Seedream — v4 and 4.5 (text-to-image and editing)
Z-Image
Recraft Crisp Upscale (image upscaling) and 851-labs Background Remover (background removal)

Video generation

Google Veo 3.1
xAI Grok Imagine (text-to-video and image-to-video)
Alibaba Wan 2.5 (text-to-video and image-to-video)

The model used for a given generation is selectable in the product interface and is labelled with its model name. This list is updated when we add or remove a model. Service performance and availability may be affected by the operational status of these providers; we will endeavour to communicate significant disruptions in a timely manner.

3. Account Registration and Eligibility

3.1 Account Creation

To use the Service you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3.2 Account Security

Notify us immediately of any unauthorised use at support@nano-banana-pro.com.
Do not share your credentials with any third party.
Keep your billing email address up to date.

3.3 Business Accounts

If you register on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

4. Plans and Credits

The Service runs on a credit system, and we offer both subscription plans and one-time credit packages:

Subscription plans — monthly and annual plans that grant a credit allowance for each billing period.
Credit packages — one-time purchases that add credits to your balance.

Generation consumes credits at a rate that depends on the model, media type and output settings you choose. Credits are non-transferable. For current plan details, credit allowances and pricing, please visit our pricing page.

We reserve the right to modify plan features, credit costs or introduce new plans at any time. Price changes are governed by Section 5.4.

5. Billing and Payment

5.1 Merchant of Record

Payments for the Service are processed by Waffo Pancake, which acts as the Merchant of Record for your purchase. Waffo Pancake sells the Service to you on our behalf, handles payment processing and applicable sales tax/VAT, and appears as the seller on your invoice. The charge on your card or bank statement may therefore show Waffo rather than "Nano Banana Pro".

Payment card data is processed exclusively by our PCI-DSS certified payment processor and is never stored on our servers.

5.2 Subscription Recurring Billing Authorisation

By subscribing to a paid plan and providing a payment method, you expressly authorise a recurring charge for the applicable subscription fee at the start of each billing period. This authorisation remains in effect until you cancel in accordance with Section 6. Your subscription renews automatically at the end of each billing period unless cancelled.

5.3 Credit Purchase Authorisation

Each credit package purchase is a single, one-time transaction authorised by you at checkout. We do not offer automatic top-up, and we will never charge your payment method for credits without an explicit checkout by you.

5.4 Taxes and Price Changes

Prices shown are exclusive of applicable taxes (VAT, GST, sales tax or similar) unless otherwise stated; where required by law, such taxes are calculated and collected at checkout by the Merchant of Record. If we change the price of a plan, we will notify existing subscribers at least 14 days before the change takes effect for their next renewal.

6. Cancellation Policy

6.1 How to Cancel

You may cancel your subscription at any time through:

Online (recommended): Account Settings → Billing → Cancel Subscription
Email: send a cancellation request from your registered email address to support@nano-banana-pro.com

You can also manage or cancel your subscription from the Waffo consumer portal at https://pancake.waffo.ai/consumer/portal/login by signing in with the email address you paid with.

6.2 Effect of Cancellation

Your subscription remains active until the end of the current paid billing period.
You will not be charged for subsequent billing periods.
Credits included in the current billing period remain usable until they expire in accordance with Section 7.3.
Account data is retained for 90 days after cancellation and then deleted, as described in our Privacy Policy.

7. Refund Policy

7.1 Subscription Refunds

7-day guarantee for first-time subscribers — a full refund is available within 7 days of your first subscription charge, provided you have used no more than 10% of that period's credit allowance.
Duplicate charge — a full refund for any billing error resulting in a duplicate charge.
Verified service outage (≥72 hours) — a pro-rated refund or credit for an extended outage within our control.
Statutory rights — where applicable law grants you withdrawal or refund rights (for example the 14-day withdrawal right in the EU/UK), those rights are preserved.

7.2 Credit Package Refunds

Unused credits within 7 days of purchase — eligible for a full refund if none of the purchased credits have been consumed.
Consumed credits are non-refundable, because the corresponding generation has already been performed and paid for at the model provider.

7.3 Subscription Credits — No Rollover

Credits granted as part of a subscription plan expire at the end of each billing period and do not carry over to the next period.

7.4 Credits After Subscription Cancellation

Credits from separately purchased credit packages keep their original validity period regardless of your subscription status, and remain usable until they expire.

7.5 Credit Consumption Order

When several credit batches are available, the batch closest to its expiry date is consumed first, whether it came from a subscription allowance or from a separate credit package. This is designed so that credits are least likely to expire unused.

7.6 Non-Refundable Items

Fees for subscription periods already used, except as stated in Section 7.1.
Credits already consumed.
Accounts terminated for violation of these Terms or the Acceptable Use Policy; on termination for violation, unused credits are forfeited without refund.

7.7 How to Request a Refund

Contact support@nano-banana-pro.com with your account email, the transaction id, and the reason for your request. We acknowledge refund requests within 2 business days and process eligible refunds within 5–10 business days through the Merchant of Record.

8. Billing Disputes

If you believe a charge is incorrect, please contact us at support@nano-banana-pro.com before disputing it with your bank. We will respond within 2 business days and resolve confirmed billing errors within 5 business days.

9. AI Output and Intellectual Property

9.1 Ownership of Outputs

Subject to these Terms, the AI-generated content produced in response to your inputs ("Outputs") is owned by you. You may use Outputs for any lawful purpose consistent with Section 10 and our Acceptable Use Policy, including commercial use.

9.2 Input Licence

By submitting prompts or reference images to the Service ("Inputs"), you grant us a limited, non-exclusive licence to process your Inputs solely in order to deliver the Service. We do not use your Inputs to train AI models without your explicit consent.

9.3 Service Content

All content provided through the Service — including the user interface, code, templates and documentation — is protected by copyright and remains our property or that of our licensors. You may not reverse engineer the Service or attempt to extract the underlying models.

9.4 Third-Party Model Dependency

Outputs are produced by the third-party models listed in Section 2.4 and are also subject to those providers' own usage policies. We do not guarantee any specific output quality and accept no liability for outputs generated by third-party models.

9.5 Accuracy of AI Outputs

AI-generated content may contain errors, artefacts or inaccuracies. You are solely responsible for reviewing and verifying Outputs before relying on or publishing them.

10. Acceptable Use

10.1 Permitted Uses

You may use the Service only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy, which forms part of these Terms and sets out our full content standards, moderation, reporting and enforcement process.

10.2 Prohibited Uses

You agree NOT to use the Service to:

Generate pornographic or NSFW content.
Generate violent or gory content outside a clear creative or educational context.
Generate hate speech or content inciting discrimination or violence.
Generate any content that sexualises minors or violates child protection laws.
Generate, distribute or facilitate deepfake content that impersonates real individuals or is intended to deceive viewers about its origin or authenticity.
Generate content that infringes the copyright, trademark, publicity or privacy rights of any third party.
Generate content that is illegal, defamatory, harassing or fraudulent.
Produce malware, phishing content or cyberattack tooling.
Circumvent or interfere with the security or content-safety features of the Service.
Use automated systems to scrape or abuse the Service, or share your credentials with unauthorised users.
Resell or sub-license access to the Service without our prior written approval.
Violate any applicable law, regulation or card network rule.

10.3 AI-Specific Prohibitions

You additionally agree NOT to:

Use Inputs, Outputs, model responses or any derivative thereof to train, fine-tune, benchmark or distil any AI or machine-learning model that competes, directly or indirectly, with the Service.
Systematically scrape, extract or harvest model outputs at scale beyond your own authorised use of the Service.
Present Outputs as the work of a human professional, or as an authentic photograph or recording of a real event, where such misrepresentation could cause harm.

10.4 Content Moderation

Every prompt submitted for generation is screened by an automated content-safety check before it reaches any model, and generation requests are sent to our model providers with their safety filters enabled. Prompts that are blocked do not consume credits. Details of the moderation, reporting and appeals process are set out in the Acceptable Use Policy.

10.5 Reporting Violating Content

If you come across generated content that violates these Terms or our Acceptable Use Policy, report it by email to: support@nano-banana-pro.com

This inbox is monitored by the operator. Please include the generation time, the account email used, and — where possible — the image or video in question. You may also use it to report AI impersonation of you or infringement of your intellectual property, publicity or privacy rights.

Reporter identity is kept confidential. We respond to critical reports (child safety, terrorism, mass violence) within 12 hours and resolve them within 24 hours; other reports are triaged by severity as set out in the Acceptable Use Policy. Enforcement can include content removal, feature restriction, account suspension, permanent ban and referral to the competent authorities. Anyone affected by an enforcement decision may appeal to the same address within 30 days.

11. Data, Privacy and Security

Your use of the Service is governed by our Privacy Policy. Payment card data is processed exclusively by our PCI-DSS certified payment processor and is not stored on our servers. Account data is retained for 90 days following cancellation and then deleted.

12. Disclaimers and Limitation of Liability

12.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUTS. We do not guarantee that generated content will meet your expectations or that the Service will be uninterrupted or error-free.

12.2 AI-Generated Content Disclaimer

⚠️ AI GENERATED CONTENT DISCLAIMER — Outputs may be inaccurate, incomplete or misleading. Do not rely on them for legal, medical, financial or other professional purposes. Always verify AI-generated content with a qualified professional before acting on it.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANO BANANA PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold us harmless from any claim, damage, loss, liability or expense (including reasonable legal fees) arising out of your use of the Service, your Inputs or Outputs, or your breach of these Terms or the Acceptable Use Policy.

14. Term and Termination

These Terms remain effective while you use the Service. We may suspend or terminate your account if you materially breach these Terms or the Acceptable Use Policy, if we suspect fraudulent activity, or where required by law. If we terminate for reasons other than your breach, we will provide a pro-rated refund for any unused prepaid period. You may delete your account at any time by contacting support@nano-banana-pro.com.

15. Governing Law and Dispute Resolution

These Terms are governed by, and construed in accordance with, the laws of the jurisdiction in which the operator of nano-banana-pro.com is resident, without regard to its conflict of law provisions. Before initiating any formal proceedings, please contact us at support@nano-banana-pro.com so we can attempt an informal resolution.

16. General Provisions

We may update these Terms at any time. Material changes will be notified by email or in-product notice at least 14 days before the effective date. Continued use constitutes acceptance. If any provision is found unenforceable, the remainder continues in full effect.
